Terms & Conditions

1. Scope

These Terms & Conditions apply to all contracts concluded between MA Lighting International GmbH ("we", "us") and a consumer for the supply of goods. A consumer is any natural person who enters into a legal transaction for purposes that can be attributed predominantly to neither commercial nor independent professional activity.

2. Contract Formation

The product displays in the online shop constitute non-binding invitations to place an order. By placing an order via the online shop, you submit a binding offer to conclude a purchase contract. We confirm receipt of your order by email (order confirmation). The order confirmation does not constitute acceptance of your offer but merely acknowledges receipt. The purchase contract is concluded when we dispatch the ordered goods and confirm dispatch to you.

3. Prices and Payment

All prices stated in the online shop include applicable statutory value added tax (VAT). Additional costs such as shipping fees are displayed separately during the ordering process. The available payment methods are shown at checkout. We reserve the right to offer or restrict payment methods depending on the order value and credit assessment.

4. Delivery

Unless otherwise agreed, delivery will be made to the delivery address provided by you. Delivery times stated in the online shop are approximate and non-binding. We will endeavour to meet the stated delivery times but cannot guarantee them. If a delivery delay occurs, we will notify you without undue delay.

Risk of accidental loss or deterioration of the goods passes to you upon handover to the carrier for consumers.

5. Retention of Title

The goods remain our property until full payment has been received. You may not sell, pledge, or otherwise dispose of the goods subject to retention of title before full payment has been made.

6. Warranty

We are liable for material and legal defects in accordance with the applicable statutory provisions. In the case of a defect, you are entitled to the statutory warranty claims. The warranty period for goods is two years from delivery of the goods to you.

7. Liability

We are liable without limitation for intent and gross negligence. In the case of slight negligence, we are only liable for injury to life, body, or health, and for breach of essential contractual obligations (cardinal obligations). In the latter case, liability is limited to the typically foreseeable damage.

8. Governing Law

The contractual relationship between you and us is governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

9. Alternative Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which can be found at https://ec.europa.eu/consumers/odr. We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
